7.5 COMPETITIONS
7.5.1 If you register for any competitions offered via this Website, the competition rules set out in this Clause 7.5, together with any other specific entry instructions or rules posted on this Website by Sonicwarp Ltd. and these User Terms (together the "Competition Rules"), shall apply.
7.5.2 All competitions, promotions, prizes or other give-aways offered by Sonicwarp Ltd. from this Website ("Competitions") are only open to individuals who are aged over 18 or have parental consent and are resident in the UK.
7.5.3 All Entrants must register for the relevant Competitions by giving their correct name and address together with their email address. By registering for the relevant Competitions, you acknowledge that you have read and agree to the provisions contained within these Terms and Conditions.
7.5.4 For the purposes of the Data Protection Act 1998, you acknowledge that in the course of entering a Competition on this Website, where you have given consent by ticking the appropriate boxes upon registration, certain personal information or data about you will be captured electronically or otherwise and transmitted to Sonicwarp Ltd. By entering into any Competition, you expressly agree to transfer such personal information or data to Sonicwarp Ltd. to use, store and process the personal information for the purposes of such Competition on this Website. Please check our privacy policy and refer to the registration page for your right to opt out of receiving information from Sonicwarp Ltd.
7.5.5 By registering for any Competitions, you agree to the use of your name and photographs for publicity material in any Sonicwarp Ltd. publications in any media, including allowing your name to be published on the Website if you are a prize winner.
7.5.6 Unless specifically stated, no purchase is necessary to enter any competitions on the Website.
7.5.7 Prizes are as stated in the Competitions' details on the Website.
7.5.8 Sonicwarp Ltd. will not offer cash alternatives in whole or in part for any prizes offered.
7.5.9 An Entrant may only win one prize per Competition. Entries to any competitions are limited to one per household.
7.5.10 All entries become the absolute property of Sonicwarp Ltd. and will not be returned to Entrants unless otherwise stated by Sonicwarp Ltd. on the Website.
7.5.11 Fraudulent, illegible, multiple or incorrectly completed entries will be disqualified and no responsibility can be accepted by Sonicwarp Ltd. for any delayed, lost or misplaced entries.
7.5.12 Monthly search awards are allocated on a per month basis. See clause 7.6 The Judge's decision is final and no correspondence will be entered into.
7.5.13 Sonicwarp Ltd. reserves the right without notice to you, to remove any Competitions from the Website or to suspend or alter any Competitions on the Website, at its sole discretion for legal or technical reasons. Sonicwarp Ltd. will give Entrants as much notice as possible prior to taking any of the actions described in this clause by posting such notice to the Website, but prior notice may not always be feasible.
7.5.14 Competitions are run subject to English law. Sonicwarp Ltd. makes no representation that the Competitions comply with the law of any other country other than the United Kingdom or that any prizes offered in Competitions are appropriate for use, or are legally able to be offered, in any other country. Those who choose to enter any Competitions on the Website are solely responsible for compliance with local laws and regulations if and to the extent they are applicable.
7.5.15 Any time of delivery is an estimate only in respect of the delivery to an Entrant of any prize in any Competitions and Sonicwarp Ltd. shall not be liable for any late delivery of the prizes or any loss or damage caused as a result.
7.5.16 Winners will be notified by post or email after the closing date given for the Competitions on the Website, when Sonicwarp Ltd. will give you details of how and when to claim your prize.
7.5.17 Every effort will be made to supply the awards stated.
7.5.18 No responsibility can be accepted by Sonicwarp Ltd. for the quality and/or suitability of any prizes provided by third parties.
7.5.19 Competitions are open to all, excluding employees, friends and family of employees, agents, or any persons professionally connected with Sonicwarp Limited.
7.6 SPECIFIC COMPETITIONS
7.6.1 SonicWarp game
7.6.1.1 Entrants must be aged 18 or over or have parental consent to participate.
7.6.1.2 Employees of Sonicwarp Limited, their agents, families or anyone else professionally connected with the competition are excluded from participating.
7.6.1.3 No purchase necessary. To enter our free monthly search, log onto www.sonicwarp.com. This free search will take place one or more times per month. A free puzzle will be allocated to the winner per search.
7.6.1.4 Closing dates for entries are the 28th day of each month.
7.6.1.5 Entry instructions are deemed to form part of the rules as are these terms and conditions. Entry into the monthly search is deemed to signify acceptance of the rules. The monthly search(es) can commence on any day during the month of each proceeding closing date. If a prize is not won after 21 days of commencement, the promoter may dispose of the prize as it thinks fit without any liability to the entrant(s) for having done so.
7.6.1.6 There is one or more prize per month . The prize is as follows:
7.6.1.6.1 One free puzzle.
7.6.1.7 The judges' decision is final. No correspondence will be entered into.
7.6.1.8 No inital registration is required for the monthly search.
7.6.1.9 The promoter reserves the right to refuse entries which are incomplete, delayed, altered, illegible, damaged or do not meet the rules.

7.6.1.11 No other alternative in part or full will be offered in lieu of the specified prizes. Prizes are not transferable.
7.6.1.12 Winners may be asked to participate in publicity.
7.6.1.13 Copyright of any entries will be owned by the promoter. Entries cannot be returned.
7.6.1.14 These rules are governed by English law and subject to the exclusive jurisdiction of the English Courts.
7.6.1.15 The promoter, where you have given consent by ticking the appropriate boxes at registration, may use the entrants' information to inform them of future promotions and products of the promoter or its associated companies that may be of interest.

8 SonicWarp online-shop
8.1 Definitions for SonicWarp Online Shop
8.1.1 With regard to the articles ordered from the SonicWarp series on the Website, the individual conditions are applicable as indicated in that part of the Website.
8.1.2 "Goods" means the merchandise manufactured or supplied by the "SonicWarp Online Shop" and the subject of the order made by you.
8.1.3 SonicWarp online shop/Us/We means Sonicwarp Limited (Company Registration Number 4186138, VAT Registration Number 875981558 trading as the SonicWarp online shop whose registered offices are at Vale Hose, Preston Brook, Runcorn WA7 3PA
8.2 Our contract
8.2.1 Our website invites you to buy goods from us. A legally binding contract with us will only arise once full payment has been received from you in relation to the Goods ordered. We shall notify you of acceptance of your order by e-mail to the e-mail address given by you in the order form.
8.2.1.2 SonicWarp Ltd do NOT sell toys. Our puzzles are designed for adults over 18 years of age.
8.2.2 Instruction as to how you can place an order
8.2.2.1 To place an order, first find a product of interest, then click add to basket. Once through to the shopping basket page, all items added to the basket will be displayed. Check all items are correct including quantities information. Select quantity. Once satisfied click on the "continue" button to continue to checkout basket or on the "back" button to resume browsing. Select a delivery option. Click on "continue" to proceed to the secure payment area of the site or "continue shopping" to return to the product listings. If you are not logged in you may be asked to do so before proceeding. If you are not yet registered with Us, You may be asked to do so before proceeding. Once at checkout, a summary of items to be purchased will be displayed together with any additional delivery charge calculation. Click on "continue" to enter payment details or "back" to return to the previous page. We do not hold any payment information relating to your transaction. 8.2.2.2 The Online order process only caters for orders placed using the English language. For enquiries using any other language email info@sonicwarp.com
8.2.2.3 Price
8.2.2.4 The price for any Goods ordered by you will be the price shown on the order confirmation section of the SonicWarp Shop web-site at the time you place your order and will include all taxes applicable.
8.2.2.5 In addition to the price, a delivery charge will be payable in respect of deliveries. The delivery charge will be that shown on the order confirmation section of the SonicWarp Shop web-site at the time of your order placement. If there is any change in the delivery charge payable, we will notify you before your order is accepted by us and ask for confirmation before proceeding.
8.2.2.6 We will debit the price, plus any delivery charge, from your debit or credit card when we receive your order or as soon as reasonably practicable thereafter.
8.2.2.7 Prices remain fixed until 30th May 2007
8.2.2.8 Clues
8.2.2.8.1 When purchasing clues via our website, you agree not to resell or publish these clues.
8.2.2.8.2 If you purchase our clues from anyone other than SonicWarp Ltd you will not be eligable to take part in the Isis Adventure.
8.3 Returns
8.3.1 If your goods are faulty we offer a money back guarantee or exchange for goods.
8.3.2 Please return items, using the form enclosed with delivery, to Sonicwarp Ltd. Vale House, Runcorn, WA7 3PA. Faulty goods will be returned at no extra cost, however, in cases where goods are not found to be faulty, a £10 admin charge will be applicable to cover handing and postage costs. Please enclose a cheque for £10 when returning items, made payable to Sonicwarp Ltd. This cheque will be returned along with the returned item in cases where items are found to be faulty. All refunds are discretionary.
8.3.3 This does not affect your statutory rights.
8.4 Cancellation by Us
8.4.1 We reserve the right to cancel your order if:
8.4.1.1 We have insufficient stock to deliver the Goods you have ordered
8.4.1.2 One or more of the Goods You ordered was listed at an incorrect price due to a typographical error or an error in the pricing information made by us and/or received by us from our suppliers.
8.4.2 If we do cancel your order we will notify you by e-mail and will re-credit to your account any sum deducted by us from your debit or credit card as soon as possible but in any event within 30 days of your order. We will not be obliged to offer any additional compensation for disappointment suffered.
8.5 Stock Shortages
8.5.1 If the Goods you order are unavailable we will notify you as soon as possible and suggest a suitable replacement or date when available.
8.5.2 The cost of returning substitute goods on cancellation will be met by Sonicwarp Limited.
8.6 Product Descriptions
8.6.1 The product information and photographs contained within our web-site are provided for illustrative purposes only and we cannot warrant that they are accurate. If you are in any doubt as to the precise nature of the product you wish to order, please contact us by e-mail.
8.6.2 Whilst every attempt will be made by the SonicWarp Shop to ensure that the Goods sold and delivered match in every respect description shown or given or sent to You, any minor or immaterial variation or change in colour or pattern between the description and the Goods delivered shall not entitle You to reject the Goods nor to claim any compensation for such variation or change.
8.7 Dispatching your goods
8.7.1 The SonicWarp Shop will despatch Your Goods to the address you have provided on the order form for dispatch and we will normally deliver within 5 working days however you should allow up to 28 days for delivery. Orders will be despatched using recorded delivery.
8.7.2 Notwithstanding clause 8.7.1, whilst we shall use our reasonable endeavors to meet the dispatch date specified by you on the order form if we cannot accept this dispatch date we reserve the right to notify you by e-mail.
8.7.3 Ownership of, and risk in, the Goods will pass to you once they have been dispatched to you. If you then return the Goods under clauses 8.3 or 8.8, ownership of, and risk in the Goods returned will pass to us on receipt of the Goods by Us.
8.8 Defective Goods
8.8.1 Faulty goods will be returned at no extra cost, however, in cases where goods are not found to be faulty, a £10 admin charge will be applicable to cover handing and postage costs. 8.10 Goods purchased from the SonicWarp Online Shop may not be resold in any form whatsoever.
8.11 Goods Purchased from the SonicWarp Online Shop may only be purchased by those over the age of 18 or with parental consent.
8.12 Use of Cards
8.12.1 By placing an order you authorise the SonicWarp Online Shop at its discretion to carry out a credit reference or other enquiry upon your financial status as SonicWarp Shop thinks fit and you agree to provide such written authorisations which may be required for the purposes of such enquiry. In the absence of such authorisation we will be unable to process your order.
8.13 Representations

8.14.1 We shall have no liability to You for any failure to deliver Goods You have ordered or for any delay in doing so or for any change of the specified delivery date or for any damage or defect to Goods delivered that is caused by any event or circumstance beyond Our reasonable control including, without limitation, third party default, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.

In the event that you're personal details become untrue, inaccurate or incomplete, or in any event, you have the right to access your personal details and may rectify the same.
17.4 Where you have provided your consent by ticking the relevant boxes upon registration, You agree that you do not object to us, our associated companies or such third parties contacting you for any of the above purposes whether by telephone, email, fax or in writing, and you confirm that you do not and will not consider any of the above as being a breach of any of your rights under the Privacy and Electronic Communications (EC Directive) Regulations.
17.5 We reserve the right to access and disclose individually identifiable information to comply with applicable laws and lawful government requests or requests by the police investigating suspected illegal activities, to operate our systems properly or to protect ourselves or other Users. We also reserve the right to disclose individually identifiable information to third parties if a complaint arises concerning your use of the Website, and that use is deemed by us inconsistent with the Conditions.
17.6 When you input information or request services from us, we offer appropriate physical, electronic and managerial security measures in order that you may input information safely whilst effectively preventing that information from being accessed by unauthorised persons. In addition, we have strict security procedures covering the storage and disclosure of your information in order to prevent unauthorised access to comply with the UK Data Protection Act 1998. This means that sometimes we may ask for proof of identity before we disclose personal information to you.

The Sonic Warp Award Zones (including Corporate Adventures).

After purchasing a Sonic Warp product from SonicWarp.com or an approved supplier, you may be given the opportunity to enter a Sonic Warp Award zone. You will be given access to a web page, which requires a username and password. You will need to register your product to receive a username and password. This may include purchasing a license key if the product is a computer game.

Once you have gained access to the Award Zone, you will be given the opportunity to win a Mystery Prize. If the Award zone relates to a Corporate Isis Adventure, you will also need to enter the 2nd Isis code before continuing. You may only select one Mystery Prize. Once you have selected a prize, all other prizes will be locked out. Any one prize may be selected by one or more players. There can be only one winner per Mystery Prize. Each prize has a clue. You will need to work out a password from the clue. The first player to work out the password will win the prize. All other players who selected this prize will be locked out from the game and as a result those players will not qualify for any further prizes. In order to re-enter the award zones, another unique isis puzzle or qualifying Sonic Warp product will need to be purchased and solved.

Details of the prize will be presented to the winner immediately after entering the correct password on the website. The prize will be awarded to the winner after the winner has contacted Sonic Warp Ltd with the correct password and prize reference number.

The Treasure Chest Game

A treasure chest token is purchased for £100.00 which is fully refundable on return of the token to Sonicwarp Ltd. These tokens must be entered into the treasure chest game by the owner of the token/s every month to qualify for any draw award. With regard to the draw each month, Sonicwarp Ltd will invite a player to witness the draw at Sonicwarp’s Head office. 

A fully refundable payment of £100.00 for purchase of a token by each player is required to play the game.
Payments are accepted in Pound Sterling only.

Payments made by Cheque will be guaranteed a full refund, other online payments such as Credit card or Debit card payments will incur small banking commission charges of 3.6%.

Refunds requested in a currency other than pound sterling will incur an additional banking charge to cover any conversion charges. Conversions will be calculated using the most current exchange rate.

Registration is required by each individual to play the Treasure chest game.

A user id and password is provided via email to each player that has correctly completed the treasure chest registration form. 

A treasure chest token certificate with a unique 10 digit number printed on it is provided to all participants that have paid £100 to play the game.

Only one token per £100.00 purchase is allowed.

Only one account permitted per person.

Payments will be refunded within 30 days of notice period. Notice must be provided in writing and acknowledgement by Sonicwarp Ltd. of the notice request is required to process the refund

Return of token/s to Sonicwarp Ltd. is required in order to process any refunds.

Registered post must be used for all token returns to Sonicwarp Ltd.

Five multi choice questions will need to be answered correctly by token owners in order to place their token/s into the treasure chest game every month. Only one attempt per month is allowed and questions must be answered within the time limit set that month.

It is not the responsibility of Sonicwarp Ltd. to enter tokens into the treasure chest for token owners.

Tokens entered into the treasure chest game every month will be drawn on the last day of the month.

Payment of monthly awards will be paid within 7 days of drawn date.

Payments requested in a currency other than pound sterling will incur a banking charge to cover any conversion charges. Conversions will be calculated using the most current exchange rate.

Proof of the valid token is required to claim the award each month for the winning account holder of the winning token.

Lost tokens must be replaced prior to any monthly draw at a cost of £10.00 per token, proof of ownership will be required, such as registration details and or email address used for the game.

The game will be launched on 1st June 2008

The Initial token purchased per account can be entered into the game in month 1 subject to correctly answering the multi choice questions.

Additional tokens purchased will not be allowed to be played until after 30 days from purchase date, subject to correctly answering the multi choice questions.

If paying by cheque, tokens will not be issued until the cheque has cleared. The 30 day period will commence from this date.

Tokens cannot be purchased or refunded on actual date of each draw, which will be the last day of each month.

Insurance protection is provided against potential loss of funds.

If at any time it is decided to discontinue the game, all payments will be returned to all players upon receipt of their tokens.

Only tokens supplied directly from Sonicwarp Limited to the registered email account will be accepted as valid. Any copied or duplicated tokens purchased from other sources will not be recognized as genuine valid tokens, and will not be entered into the game.

Genuine tokens cannot be re-sold to another person, in this event the token should be returned to Sonicwarp for a refund, and the new interested party must register independently for a new token.

Anyone that introduces a friend to the game, will be eligible for a bonus token, subject to the friend registering and paying £100.00. Friends that already have an account at sonicwarp.com are not eligable for this scheme.

If the friend later leaves the game, the bonus token that was added to the beneficiary's account will be removed.

All bonus tokens are assigned to one account and cannot be used against another account.

Bonus tokens have NO monetary value, and are used only against one account holder to increase the account holders stake on the treasure chest fund, when they win.

Once bonus tokens are assigned to an account they remain live (subject to point 33) until the account holder requests to leave the game, at which point all bonus tokens for that account are removed from that account.

Maximum 30 bonus tokens per person.

There is only one opportunity to answer the five questions correctly per month.

Questions cannot be accessed or answered on actual draw dates, usually last day of each month.

All five questions per month must be answered correctly within a two minute time period in order to qualify for the draw each month.

Five new questions will be provided every calendar month for each new draw.

If at any point Sonicwarp Limited discover that the system is being abused by an account holder in a fraudulent or other unlawful manner, Sonicwarp Limited will close that account and return the payments to that account holder.

Any account holder that has had their account closed due to unlawful behavior by the account holder, that account holder will not be eligible to play the game in the future.

The promoter reserves the right to amend, alter or withdraw the promotion as necessary due to exceptional circumstances outside of its control.

Claimants may be asked to participate in publicity.

If the claimant of the prize cannot be traced after reasonable efforts have been made by the promoter, then the promoter may dispose of the prize as it thinks fit without any liability to the claimant for having done so.

The promoter reserves the absolute right to disqualify any entrant to any promotion which it considers has used improper technical means to enter.

Entry instructions are deemed to form part of these terms and conditions and entry into this promotion is deemed to signify acceptance of the rules.

These rules are governed by English law and subject to the exclusive jurisdiction of the English Courts.
